§ 114‑19.20.  Criminalrecord checks for the Office of Information Technology Services.

(a)        The Department ofJustice may provide to the Office of Information Technology Services from theState and National Repositories of Criminal Histories the criminal history ofany current or prospective employee, volunteer, or contractor of the Office ofInformation Technology Services. The Office of Information Technology Servicesshall provide to the Department of Justice, along with the request, thefingerprints of the current or prospective employee, volunteer, or contractor,a form signed by the current or prospective employee, volunteer, or contractorconsenting to the criminal record check and use of fingerprints and otheridentifying information required by the State and National Repositories, andany additional information required by the Department of Justice. Thefingerprints of the current or prospective employee, volunteer, or contractorshall be forwarded to the State Bureau of Investigation for a search of theState's criminal history record file, and the State Bureau of Investigationshall forward a set of fingerprints to the Federal Bureau of Investigation fora national criminal history record check. The Office of Information TechnologyServices shall keep all information obtained pursuant to this sectionconfidential.

(b)        The Department ofJustice may charge a fee to offset the cost incurred by it to conduct acriminal record check under this section. The fee shall not exceed the actualcost of locating, editing, researching, and retrieving the information. (2007‑155, s. 3; 2007‑189,ss. 3, 5.1.)
