§ 143‑64.5. Department of Agriculture and Consumer Services exempted from application ofArticle.

Notwithstanding any provisions or limitations of Part 2 of thisArticle, the North Carolina Department of Agriculture and Consumer Services isauthorized and empowered to distribute food, surplus commodities andagricultural products under contracts and agreements with the federalgovernment or any of its departments or agencies, and is authorized andempowered to adopt rules in order to conform with federal requirements andstandards for such distribution and also for the proper distribution of suchfood, commodities and agricultural products. To the extent set forth above andin this section, the provisions of Part 2 of this Article shall not apply tothe North Carolina Department of Agriculture and Consumer Services.
