§ 153A‑226.  Sanitationand food.

(a)        The Commission forPublic Health shall adopt rules governing the sanitation of local confinementfacilities, including the kitchens and other places where food is prepared forprisoners. The rules shall address, but not be limited to, the cleanliness offloors, walls, ceilings, storage spaces, utensils, ventilation equipment, andother facilities; adequacy of lighting, water, lavatory facilities, bedding,food protection facilities, treatment of eating and drinking utensils, andwaste disposal; methods of food preparation, handling, storage, and serving;and any other item necessary to the health of the prisoners or the public.

(b)        The Commission forPublic Health shall prepare a score sheet to be used by local health departmentsin inspecting local confinement facilities. The local health departments shallinspect local confinement facilities as often as may be required by theCommission for Public Health. If an inspector of the Department findsconditions that reflect hazards or deficiencies in the sanitation or foodservice of a local confinement facility, he shall immediately notify the localhealth department. The health department shall promptly inspect the facility.After making its inspection, the local health department shall forward a copyof its report to the Department of Health and Human Services and to the unitoperating the facility, on forms prepared by the Department of Environment andNatural Resources. The report shall indicate whether the facility and itskitchen or other place for preparing food is approved or disapproved for publichealth purposes. If the facility is disapproved, the situation shall berectified according to the procedures of G.S. 153A‑223.
