When any city proposes to make local improvements that would benefitlands owned by the State of North Carolina or any board, agency, commission, orinstitution thereof, the council may request the Council of State to consent tospecial assessments against the property. The Council of State may authorizethe Secretary of Administration to give consent for special assessments againstState property, but the city may appeal to the Council of State if theSecretary of Administration refuses to give consent. When consent is given forspecial assessments against State lands, the Council of State may direct thatthe assessment be paid from the Contingency and Emergency Fund of the State ofNorth Carolina or from any other available funds. If consent to the assessmentis refused, the state‑owned property shall be exempt from assessment. (1971, c. 698, s. 1; 1975, c. 879, s. 46.)
