(a) It shall beunlawful for any telephonic seller to make a telephone solicitation orattempted telephone solicitation involving any gift or prize when thesolicitation or attempted solicitation:
(1) Requests or directsthe consumer to further the transaction by calling a 900 number or a pay‑per‑callnumber.
(2) Requests or directsthe consumer to send any payment or make a donation in order to collect thegift or prize.
(3) Does not complyfully with G.S. 75‑30, 75‑32, 75‑33, or 75‑34.
(b) Notwithstandingsubsection (a) of this section, a telephonic seller may offer a gift or prizein connection with the bona fide sale of a product or service. (1997‑482,s. 1.)
