3734.132 Secretary of state as agent for service of process.

Any person who files a consent-to-jurisdiction document under division (A)(1) or (3) of section 3734.131 of the Revised Code, by the filing of that document, makes and constitutes the secretary of state his agent for the service of process in this state, including, without limitation, summonses and subpoenas, for any civil or criminal proceeding arising out of or relating to the solid wastes that the person transports from outside this state to a solid waste facility in this state. Service of process upon any such person may be initiated by leaving with the secretary of state or an assistant secretary of state four copies of the process, together with an affidavit stating the address of the person given on the consent-to-jurisdiction document and a fee of five dollars. Upon receipt of the process, affidavit, and fee, the secretary of state immediately shall give notice to the person at the address given in the affidavit and forward to that address by certified mail, return receipt requested, a copy of the process. Service is deemed to be complete upon the mailing of the notice and copy of the process in accordance with this section.
