SECTION 21-28-3.07

   § 21-28-3.07  Qualifications for licensees.– (a) No license shall be issued under § 21-28-3.06 unless and until theapplicant for the license has furnished proof satisfactory to the department:

   (1) That the applicant is of good moral character or, if theapplicant is an association or corporation, that the managing officers are ofgood moral character.

   (2) That the applicant is equipped as to land, buildings, andparaphernalia to properly carry on the business prescribed in his or herapplication.

   (3) That the applicant maintains effective controls againstdiversion of controlled substances into other than legitimate channels.

   (b) No license shall be granted to any person who has withinfive (5) years been convicted of a willful violation of any law of the UnitedStates or of any state relating to controlled substances.
