SECTION 28-40-3.3

   § 28-40-3.3  Penalty for misappropriation.– Any employer and any officer, agent, servant, or employee of any corporateemployer responsible for either the withholding or payment of contributions,who appropriates or converts the contributions withheld to his or her own useor to any use other than the payment of the contributions, to the extent thatthe money required to be withheld is not available for payment on the due dateas prescribed in this chapter, shall upon conviction for each offense be finednot more than one thousand dollars ($1,000) or be imprisoned for not exceedingone year, or shall be both fined and imprisoned, the fine and imprisonment tobe in addition to any other penalty provided by this chapter.
