SECTION 42-8.1-17

   § 42-8.1-17  Duties of agencies. – It shall be the duty of each agency of the state and political subdivisionthereof to:

   (1) Cause to be made and preserved records containingadequate and proper documentation of the organization, functions, policies,decisions, procedures, and essential transactions of the agency and designed tofurnish the information necessary to protect the legal rights of the governmentand of the persons directly affected by agency's activities;

   (2) Cooperate fully with the division in complying with theprovisions of this chapter;

   (3) Establish and maintain an active and continuing programfor the preservation of records of permanent legal or historical value andassist the division to implement the provisions of this chapter;

   (4) Establish necessary safeguards against the removal orloss of records. These safeguards shall include notification to all officialsand employees of the agency that no records in the custody of the agency are tobe alienated or destroyed except in accordance with the provisions of thischapter, §§ 38-1-10 and 38-3-6;

   (5) Designate an agency records officer who shall establishand operate an archives and records management program for the agency incooperation with the division of state archives and the public recordsadministration. This officer may also serve as the agency forms managementrepresentative as required by § 42-84-5.
