1-26A-3. Validity of published rules not contestable on procedural grounds. Except as provided in § 1-26A-4, no action or proceeding may be brought to contest the validity of any rule contained in the 1974 Administrative Rules of South Dakota on the ground that the agency failed to comply with the procedural requirements of chapter 1-26. Nothing in this section shall restrict a person's right to initiate an action or proceeding to challenge the validity of the substance of any such rule.
