24-11A-15. Negotiation of services by secretary of Board of Corrections. Subject to legislative appropriation, the secretary may, without competitive bids or by competitive bidding, negotiate and contract with any adult community corrections facility created under this chapter, to provide services for:
(1) Offenders ordered by a sentencing court to participate in local community corrections facilities or programs as a condition of probation; or
(2) Inmates transferred to a residential adult community corrections facility by the warden as provided by § 24-11A-13; or
(3) Parolees, as a condition of release, determined by the Board of Pardons and Paroles to be better served and monitored in an adult community correctional facility or program. In addition, a parole agent, with the approval of the director of parole services and subject to review of the Board of Pardons and Paroles, may assign a parolee in violation of parole to an adult community corrections facility or program.
