34A-1-24. Application for variance from rules. Any person who owns or is in control of any plant, building structure, process, or equipment may apply to the board for a variance from rules governing the quality, nature, duration, or extent of emissions. The application shall be accompanied by such information and data as the board may require. However, no variance may be granted for any facility subject to Title V of the Federal Clean Air Act 42 U.S.C. §§ 7401 to 7642, inclusive, as amended to January 1, 1995.
