32B-4-506 (Effective 07/01/11). Conflicting interests.
(1) A commissioner, the director, or a department employee may not be directly orindirectly interested or engaged in another business or undertaking dealing in an alcoholicproduct:
(a) as:
(i) an owner;
(ii) a part-owner;
(iii) a partner;
(iv) a member of a syndicate;
(v) a shareholder;
(vi) an agent; or
(vii) an employee; or
(b) (i) for the commissioner's, director's, or department employee's own benefit; or
(ii) in a fiduciary capacity for another person.
(2) A commissioner, the director, or a department employee may not enter into orparticipate in a business transaction with staff of a supplier of an alcoholic product to thedepartment as:
(a) a partner;
(b) a co-owner;
(c) a joint venturer; or
(d) a shareholder.
(3) The following are governed by Title 67, Chapter 16, Utah Public Officers' andEmployees' Ethics Act:
(a) a commissioner;
(b) the director; or
(c) a department employee.
(4) This section does not prevent the purchase of an alcoholic product as authorized bythis title by a commissioner, the director, or a department employee.
