11-10-1 (Superseded 07/01/11). Business license required -- Authorization forissuance, denial, suspension, or revocation by local authority.
(1) As used in this chapter, the following have the meaning set forth in Section32A-1-105:
(a) "club licensee";
(b) "local authority";
(c) "person"; and
(d) "restaurant."
(2) A person may not operate an association, restaurant, club license, or similar businessthat allows customers, members, guests, or other persons to possess or consume alcoholicbeverages on the premises of the club licensee, association, restaurant, or similar businesspremises without a business license.
(3) Any local authority may issue a business license to any person who owns or operatesan association, restaurant, club license premise, or similar business that allows the customers,members, guests, or other persons to hold, store, possess, or consume alcoholic beverages on thepremises. This license does not permit any person to hold, store, possess, or consume alcoholicbeverages on the premises other than as provided in Title 32A, Alcoholic Beverage Control Act.
(4) Any local authority may suspend or revoke a business license for a violation of Title32A, Alcoholic Beverage Control Act.
(5) Each local authority shall set policy by written rules that establish criteria andprocedures for granting, denying, suspending, or revoking licenses issued under this chapter.
(6) A license issued under this section constitutes consent of the local authority withinthe meaning of Title 32A, Alcoholic Beverage Control Act.
