TITLE 3ExecutiveAppendix Executive OrdersCHAPTER 3. EXECUTIVEExecutive Order No. 3-15.(No. 70-89)[Abolition of Office on Aging and Transfer of Functions of CertainDivisions to and Establishment of Department of Rehabilitation andAging]

WHEREAS, the Agency of Human Services established by Title 3, chapter 53, is organized to ensure that resources, financial, human and physical, are managed effectively in addressing the human service needs of all Vermonters; and

WHEREAS, it is desirable to streamline and reorganize departments and divisions within the Agency by combining certain activities and to avoid duplication and improve communication; and

WHEREAS, the Secretary of the Agency has completed an examination of major functions associated with improving services to older persons and individuals requiring long term care or rehabilitation services;

NOW, THEREFORE, BE IT RESOLVED THAT I, Madeleine M. Kunin, by virtue of the authority vested in me by 3 V.S.A. chapter 41, do hereby reorganize the Agency of Human Services as follows:

The Department of Rehabilitation and Aging is established within the Agency of Human Services.

1) The Chief Executive and Administrative Officer and head of the Department of Rehabilitation and Aging shall be the Commissioner of Rehabilitation and Aging.

2) All duties, responsibilities, and authority with respect to the Office on Aging and the director of that office presently granted under the provisions of 3 V.S.A. sections 3088 and 3089 and any other chapter or section of the Vermont Statutes Annotated or elsewhere are hereby transferred to the Department of Rehabilitation and Aging, and the Office on Aging is abolished as a free standing division within the Agency of Human Services.

3) All duties, responsibilities, and functions currently vested in the Division of the Blind and Visually Impaired of the Department of Social and Rehabilitation Services presently granted under the provisions of 3 V.S.A. section 3084 and 33 V.S.A. section 2595 and any other chapter or section of the Vermont Statutes Annotated or elsewhere are hereby transferred to the Department of Rehabilitation and Aging.

4) All duties, responsibilities, and authority of the Division of Vocational Rehabilitation of the Department of Social and Rehabilitation Services and the Director of the Division of Vocational Rehabilitation presently granted under the provisions of 3 V.S.A. sections 3054 and 3084, and 33 V.S.A. section 2595 and any other chapter or section of the Vermont Statutes Annotated or elsewhere are hereby transferred to the Department of Rehabilitation and Aging.

5) The duties, responsibilities, and authority of the Division of Licensing of the Department of Social and Rehabilitation Services pertaining to level IV facilities presently granted under the authority of 18 V.S.A. chapter 45 and 33 V.S.A. section 2596 and any other chapter or section of the Vermont Statutes Annotated or elsewhere are hereby transferred to the Department of Rehabilitation and Aging.

6) All of the duties, responsibilities, and authority of the Division of Medical Care Regulation of the Department of Health pertaining to level I and level II nursing homes and level III residential care homes, hospitals, and home health services presently granted under the authority of 18 V.S.A. chapters 43, 45 and 57 and any other chapter or section of the Vermont Statutes Annotated or elsewhere are hereby transferred to the Department of Rehabilitation and Aging.

7) All authorized positions and equipment of the Office on Aging are transferred to the Department of Rehabilitation and Aging.

8) The exempt position of the Director of the Office on Aging is redesignated as Commissioner of Rehabilitation and Aging.

9) All authorized positions and equipment of the Division of the Blind and Visually Impaired of the Department of Social and Rehabilitation Services are transferred to the Department of Rehabilitation and Aging.

10) All authorized positions and equipment of the Division of Vocational Rehabilitation of the Department of Social and Rehabilitation Services are transferred to the Department of Rehabilitation and Aging.

11) The following positions of the Division of Licensing of the Department of Social and Rehabilitation Services are hereby transferred to the Department of Rehabilitation and Aging:

12) The following positions of the Division of Medical Care Regulation of the Department of Health are hereby transferred to the Department of Rehabilitation and Aging:

All authorized positions and equipment assigned to the departments and offices reorganized under this executive order may be transferred pursuant to Title 3 sections 2003-2007 in order to effect the above-mentioned reorganization.

This executive order shall take effect on May 1, 1989, unless disapproved by the General Assembly pursuant to 32 V.S.A. section 2002. This executive order shall be submitted to the General Assembly pursuant to 32 V.S.A section 2002(b).
