§ 2.2-2503. Special Advisory Commission on Mandated Health InsuranceBenefits; membership; terms; meetings; compensation and expenses; staff;chairman's executive summary.

A. The Special Advisory Commission on Mandated Health Insurance Benefits (theCommission) is established as an advisory commission within the meaning of §2.2-2100, in the executive branch of state government. The purpose of theCommission shall be to advise the Governor and the General Assembly on thesocial and financial impact of current and proposed mandated benefits andproviders, in the manner set forth in this article.

B. The Commission shall consist of 18 members that include six legislativemembers, 10 nonlegislative citizen members, and two ex officio members asfollows: one member of the Senate Committee on Education and Health and onemember of the Senate Committee on Commerce and Labor appointed by the SenateCommittee on Rules; two members of the House Committee on Health, Welfare andInstitutions and two members of the House Committee on Commerce and Laborappointed by the Speaker of the House of Delegates in accordance with theprinciples of proportional representation contained in the Rules of the Houseof Delegates; 10 nonlegislative citizen members appointed by the Governorthat include one physician, one chief executive officer of a general acutecare hospital, one allied health professional, one representative of smallbusiness, one representative of a major industry, one expert in the field ofmedical ethics, two representatives of the accident and health insuranceindustry, and two nonlegislative citizen members; and the State Commissionerof Health and the State Commissioner of Insurance, or their designees, whoshall serve as ex officio nonvoting members.

C. All nonlegislative citizen members shall be appointed for terms of fouryears. Legislative and ex officio members shall serve terms coincident withtheir terms of office. All members may be reappointed. However, no Housemember shall serve more than four consecutive two-year terms, no Senatemember shall serve more than two consecutive four-year terms, and nononlegislative citizen member shall serve more than two consecutive four-yearterms. Vacancies occurring other than by expiration of a term shall be filledfor the unexpired term. Vacancies shall be filled in the manner as theoriginal appointments. The remainder of any term to which a member isappointed to fill a vacancy shall not constitute a term in determining themember's eligibility for reappointment.

D. The Commission shall meet at the request of the chairman, the majority ofthe voting members or the Governor. The Commission shall elect a chairman anda vice-chairman, as determined by the membership. A majority of the membersof the Commission shall constitute a quorum.

E. Legislative members of the Commission shall receive such compensation asprovided in § 30-19.12, and nonlegislative citizen members shall receive suchcompensation for the performance of their duties as provided in § 2.2-2813.All members shall be reimbursed for all reasonable and necessary expensesincurred in the performance of their duties as provided in §§ 2.2-2813 and2.2-2825. Funding for the compensation and costs of expenses of the membersshall be provided by the State Corporation Commission.

F. The Bureau of Insurance, the State Health Department, and the JointLegislative Audit and Review Commission and such other state agencies as maybe considered appropriate by the Commission shall provide staff assistance tothe Commission. The Joint Legislative Audit and Review Commission shallconduct assessments, analyses, and evaluations of proposed mandated healthinsurance benefits and mandated providers as provided in subsection D of §30-58.1, and report its findings with respect to the proposed mandates to theCommission.

G. The chairman of the Commission shall submit to the Governor and theGeneral Assembly an annual executive summary of the interim activity and workof the Commission no later than the first day of each regular session of theGeneral Assembly. The executive summary shall be submitted as provided in theprocedures of the Division of Legislative Automated Systems for theprocessing of legislative documents and reports and shall be posted on theGeneral Assembly's website.
