§ 46.2-323.01. Issuance of documents; relationship with federal law.

A. The Department shall establish a process for persons who, for reasonsbeyond their control, are unable to provide all necessary documents requiredfor driver's licenses, permits, and special identification cards and mustrely on alternate documents to establish identity or date of birth.Alternative documents to demonstrate legal presence will only be allowed todemonstrate United States citizenship.

B. The Department shall not comply with any federal law or regulation thatwould require the Department to use any type of computer chip orradio-frequency identification tag or other similar device on or in adriver's license or special identification card.
