§ 46.2-341.18:01. Disqualification for violation of out-of-service order;commercial motor vehicle designed to transport 16 or more passengers;commercial motor vehicle used to transport hazardous materials.

The Commissioner shall disqualify, for a period of two years, any personconvicted of violating an out-of-service order while operating (i) acommercial motor vehicle designed to transport 16 or more passengers,including the driver, or (ii) notwithstanding the provisions of §46.2-341.18, a commercial motor vehicle while used in the transport ofhazardous materials required to be placarded under federal HazardousMaterials Regulations (49 C.F.R. Part 172, Subpart F). If the person isconvicted of two or more violations of this section, and each offense arosefrom a separate incident committed within a period of 10 years, thedisqualification shall be for five years.
