§ 59.1-371. Fingerprints and background investigations; investigations fromother states.

A. The Commission shall fingerprint and require a background investigation toinclude a criminal history record information check of the following personsto be conducted by a representative of a law-enforcement agency of theCommonwealth or federal government: (i) every person licensed to hold racemeetings within the Commonwealth of Virginia; (ii) every person who is anofficer or director or principal stockholder of a corporation which holdssuch a license, and every employee of the holder of any such license whoseduties relate to the horse racing business in Virginia; (iii) all securitypersonnel of any license holder; (iv) members and employees of the VirginiaRacing Commission; (v) all permit holders, owners, trainers, jockeys,apprentices, stable employees, managers, agents, blacksmiths, veterinarians,employees of any license or permit holder; and (vi) any person who activelyparticipates in the racing activities of any license or permit holder.

B. Notwithstanding the provisions of subsection A, the Commission may, (i) byregulation, establish a procedure to recognize a license or permit issued byanother state in which horse racing is authorized when the Commission in itsdiscretion determines that the laws or requirements of the licensingauthority for such state governing fingerprinting and backgroundinvestigations are substantially the same as required under this chapter andCommission regulations, and that the applicant has not been convicted of amisdemeanor or felony as provided in subdivision B 6 of § 59.1-389 and (ii)waive the requirements for fingerprints and background investigations forpermit holders participating in (a) horse racing in nonsecure areas or (b)nonracing activities.
