§291E-35  Immediate restoration of licenseand motor vehicle registration.  (a)  In cases involving an alcohol relatedoffense, if a test conducted in accordance with part II and section 321‑161and the rules adopted thereunder shows that a respondent had an alcoholconcentration less than .08, the director or the arresting law enforcementagency immediately shall return the respondent's license, and if applicable,motor vehicle registration and any number plates taken into custody, along witha certified statement that administrative revocation proceedings have beenterminated with prejudice.

(b)  In cases involving a drug related offense,if a test conducted in accordance with part II and section 321‑161 andthe rules adopted thereunder fails to show the presence, in the respondent'sblood or urine, of any drug that is capable of impairing the respondent'sability to operate a vehicle in a careful and prudent manner, the director orthe arresting law enforcement agency immediately shall return the respondent'slicense, and if applicable, motor vehicle registration and any number platestaken into custody, along with a certified statement that administrativerevocation proceedings have been terminated with prejudice.
