§302A-1503  Donated school equipmentand fixtures; repair and maintenance responsibility.  (a)  Thedepartment may accept donations of school equipment or fixtures on behalf ofthe department, individual schools, or school complexes.  Donations that meet currenteducational specifications or exceed existing educational specifications shallbe deemed acceptable in instances where the donations enhance the schoolenvironment or improve the administration of school programs in accordance withcriteria established by the department pursuant to chapter 91.

(b)  The department may accept a donation onlyif the equipment or fixture is useful to enhance the physical environment orsafety of a school, or is a benefit to learning.

(c)  The private source making a donation shallnot be liable upon any claim for injury arising from the donated equipment orfixture; provided that this provision shall not affect the responsibility orliability of manufacturers of defective products nor shall it affect theresponsibilities of negligent persons who cause dangerous conditions thatresult in injury.
