§302A 601 - .3 Newly hired employees; paycheck deficits; partial wages.
[§302A‑601.3] Newly hired employees;paycheck deficits; partial wages. (a) The department shall establish andimplement appropriate policies, procedures, technology, and accountabilitymeasures to ensure that newly hired employees receive timely and accuratewages.
(b) All newly hired employees shall receivetheir first paycheck no later than the second pay period after the date oftheir hire by the department.
(c) If the department is unable to pay thetotal wages due a newly hired employee pursuant to subsection (b), thedepartment may pay the newly hired employee on the day the newly hired employeewould have received pay, partial wages in an amount not less than fifty percent of the amount due for the second pay period and for each consecutive payperiod thereafter in which the department maintains a paycheck deficit with thenewly hired employee. The amounts received shall be deducted from the totalwages due for the respective pay period. Once the department resolves thepaycheck deficit, the newly hired employee shall no longer receive partialwages as provided by this subsection. [L 2005, c 159, §7]

L 2005, c 159, §§8 to 10 provide:
"SECTION 8. By December 31, 2005, the department shalladopt rules pursuant to chapter 91, Hawaii Revised Statutes, as may benecessary to administer section 7 [§302A-601.3].
SECTION 9. The department of education shall provide eachnewly hired teacher with the new teacher orientation handbook to assist intheir transition into the department's school system. The handbook shall serveas a reference guide and to provide the new employees with information on thefollowing:
(1) Professionaldevelopment and incentive programs;
(2) Licenserequirements; and
(3) Otheruseful information to assist new teachers with their familiarity of thedepartment's organization and educational system.
SECTION 10. The department of education shall establish andmaintain a standardized statewide teacher induction program that is availableto every newly hired teacher. The program shall ensure that the new teacher tomentor ratio is no greater than fifteen to one and that all mentors arespecially skilled and trained to work effectively with newly hired teachers asdetermined by the department."
