76-22-12. Standards.

To fulfill the purposes of the Organic Commodity Act, the commission may prescribe and adopt standards relating to the production, handling, processing and distribution of organically produced food articles.  Under this section, the commission is empowered to adopt and promulgate certification standards for the production, handling, processing and distribution of organically produced food articles, and agricultural commodities, including setting reasonable application fees and requirements.  Where a production or handling practice is not prohibited or otherwise restricted, the practice shall be permitted unless the commission determines that the practice would be inconsistent with the purposes of the Organic Commodity Act.
