§ 4743. Deer; special season for taking by muzzle loading firearm

(a) For the nine consecutive calendar days commencing on the first Saturday after the completion of the regular deer hunting season, a person may take one wild deer by muzzle loading firearm provided, that only deer with antlers of three (3) inches or greater length may be taken unless the board has established an antlerless deer season pursuant to section 4081 of this title. A person hunting under a second license pursuant to subdivision 4252(9) of this title may take one additional deer and may hunt only in management units designated by the board. The board shall determine if a person hunting under a second license may take antlerless deer as well as antlered deer.

(b) Persons wishing to hunt with a muzzle loading firearm under this section shall obtain a license as provided in section 4255 of this title.

(c) Persons licensed pursuant to this section shall not carry while hunting during the special season, any firearms other than one single barreled muzzle loading firearm as defined in subdivision 4001(33) of this title.

(d) Persons violating the provisions of this section shall be subject to the penalties set forth in section 4518 of this title.

(e) Any muzzle loading firearm defined under subdivision 4001(33) of this title or used pursuant to any other section of the fish and wildlife regulations of the state of Vermont shall be considered loaded when it has been charged with powder and projectile and is primed or capped.
