§ 863. Procedure on appeal; commissioners

When the appeal is entered in the superior court with the report of the selectmen in writing, in its discretion, upon hearing, the court may accept or reject the award, or may appoint a commission consisting of three disinterested freeholders of the vicinity, who shall make examination of the premises. After notice to the parties and hearing, such commissioners shall make report thereof to the court within thirty days thereafter, or within such further time as the court upon request may fix.
