§ 7103. Jurisdiction

(a) The youth court shall have jurisdiction in cases referred from court diversion. The youth court may not consider any matter affecting a child unless that child first has been deemed eligible to participate in the court diversion program. Referrals to the youth court shall come from court diversion either on the court diversion's own recommendation or upon the recommendation of the state's attorney. In the event of a recommendation by the state's attorney, the court diversion board retains the right to decline to forward the matter to the youth court.

(b) A child referred to the youth court may decline the referral and choose, instead, to resolve the matter with court diversion.

(c) Upon referral and application to court diversion, court diversion shall gather information relevant to the child and the charge and may, if it chooses, share this information with the youth court. (Added 1995, No. 18, § 1.)
