§ 4307. -Hearing; orders

When it appears upon such inspection that any establishment is being maintained or operated in violation of the provisions of this subchapter, the board shall cause written notice thereof, together with an order commanding an abatement of such violation and a compliance with this subchapter within a reasonable period of time to be fixed in the order, to be served by a proper officer upon the person violating such provisions. Under such rules and regulations as may be prescribed by the board, a person upon whom such notice and order are served shall be given an opportunity to be heard and to show cause why such order should be vacated or amended. When, upon such hearing, it appears that the provisions of this subchapter have not been violated, the board shall immediately vacate such order, but without prejudice. When, however, it appears that such provisions have been violated and such person fails to comply with an order issued by the board under the provisions of this section, the board shall, forthwith, certify the facts to the proper prosecuting officer.
