§ 1861. Definitions

When used in this subchapter:

(1) "Municipality" shall include a city, town or incorporated village.

(2) "Off street public parking project" means the acquisition of any land or any interest therein or structure to be used for the parking of vehicles, and the improvement thereof and the funding of any bonds previously issued under this subchapter for an off street public parking project.

(3) "Improvement" means any extension, betterment, or addition to an off street parking project and includes without limitation the demolition or removal of structures on an area to be used for off street public parking, the surfacing of all or a part of such area with pavement of a lasting character, the purchase and installation of parking meters or other devices or methods for obtaining revenue, the constructing of buildings, ramps, approaches or other structures used for the storing or parking of vehicles or useful in connection therewith.

(4) "Cost of an off street public parking project" means the cost of acquiring land for an off street parking project and the improvement thereof including, without limitation, all preliminary expenses, the cost of acquiring all property, franchises, easements, and rights in the judgment of the legislative body necessary or convenient therefor, also including engineering and legal expenses, expenses for estimates of costs and revenues, expenses for plans, specifications and surveys, parking meters and the costs of installation thereof, other expenses incident or necessary to determining the feasibility or practicability of the project, administrative expenses, and such other expenses as may be incurred in the acquisition or improvement of the off street public parking project, the placing of such in operation, and the performance of the things herein required or permitted in connection therewith.

(5) "Acquire" means to purchase, to take by eminent domain, to lease, to construct, to replace, to renew, to extend or to improve.

(6) "Bond" means any bonds, notes, interim certificates, or other obligations issued by the municipality and payable out of the revenues from an off street public parking project, from the operation of parking meters in public streets or from the operation of other off street public parking areas.

(7) "Revenues" means all rates, fees, charges or other income received by the municipality, or accrued to the municipality, or any board or agency thereof in control of the management and operation of said off street public parking project, parking meters on streets or other off street public parking areas.

(8) "Legislative body" means the mayor and board of aldermen of a city, the board of selectmen of a town, and the president and trustees of an incorporated village.
