§ 372. Proceedings when grantor refuses to acknowledge-Summons

When a grantor or lessor refuses to acknowledge his deed, the grantee or lessee, or a person claiming under him, may apply to a district judge who shall thereupon issue a summons to the grantor or lessor to appear at a certain time and place before him to hear the testimony of the subscribing witnesses to the deed. Such summons, with a copy of the deed annexed, shall be served like a writ of summons, seven days at least before the time therein assigned for proving the deed. (Amended 1973, No. 249 (Adj.
