§ 641. Vermont breeder's stake board

(a) The Vermont breeder's stake board is created. The purpose of the board is to promote improvement of standard-bred horse breeding in the state, and to direct the administration of the Vermont standard-bred development special fund created by section 642 of this title.

(b) The board shall consist of five members, each to be appointed by the governor for a three-year term. Each member shall be a resident of the state. No member shall serve more than two consecutive terms. Vacancies shall be filled in the same manner as the original appointment for any unexpired term.

(c) As funds permit, the board shall arrange for one or more breeder's stake horse racing events in the state each year, with a goal that only Vermont bred horses shall participate by 1996 and thereafter.

(d) The secretary of agriculture, food and markets shall provide administrative services to the board, and shall be appropriately compensated from the special fund established by section 642 of this title in accordance with the special fund state policy established by subchapter 5 of chapter 7 of Title 32.

(e) The board may accept private donations and grants to carry out its purposes.

(f) The board may adopt rules under chapter 25 of Title 3 to interpret and carry out the provisions of this section and of section 642 of this title, including the requirement that owners of horses participating in Vermont breeder's stake events authorized by this section shall first pay nominating, sustaining and starting fees as set by the board.
