10-1203.   Duplication of existing utility services; approval andfinding by corporation commission.No municipality, as herein defined, shall issue revenue bonds toacquire, construct, reconstruct, alter, repair, improve, extend or enlargeany plant or facilities for the furnishing of any utility service wheresame is being furnished by a private utility, except upon approval by thecorporation commission of the state of Kansas, after a finding based onsubstantial evidence that the acquisition, construction, reconstruction,alteration, repair, improvement, extension or enlargement of such plant orfacilities is necessary or appropriate for the municipality and itsconsumers, and for the protection of investors and will not result in theduplication of existing utility services in the area served or to be servedby the municipality.
