12-110b. Special fund for law enforcement and purchase of ambulanceand firefighting equipment; tax levies, use of proceeds; protest petitionand election; investment of fund.The governing body of any city proclaimed by the governor as a city ofthe first class not more than five years preceding the effective date ofthis act or hereafter and the governing body of any city of the secondand third class is hereby authorized to make an annual tax levy of notto exceed two mills upon all the taxable tangible property in the cityfor the purpose of creating and providing a special fund to be used forlaw enforcement purposes or for the purchase of ambulance equipment orfire-fighting equipment, or both, for such city and to pay a portion of theprincipal and interest on bonds issued by such city under the authorityof K.S.A. 12-1774 and amendments thereto. No city shallmake an annual levy under the provisions of this section until thegoverning body of such city has adopted a resolution authorizing themaking of such levy. Such resolution shall be published once each weekfor two consecutive weeks in the official city newspaper. After publication,an annual levy may be made unless a petition requesting an electionupon the proposition of levying the tax, signed by not less than 5%of the qualified electors of the city, is filed with thecounty election officer within 30 days following the date ofthe last publication of the resolution. If such a petition isfiled, no such annual levy shall be made without such proposition havingbeen submitted to and having been approved by a majority of the electorsvoting thereon at the next primary or general election, or if suchprimary or general election does not take place within 60 daysafter the date the petition was filed, at a special election called andheld thereon. All such special elections shall be called and held in themanner prescribed for the calling and holding of elections under thegeneral bond law. The governing body may invest anyportion of such special fund which is not currently needed ininvestments authorized by K.S.A. 12-1675 and amendmentsthereto in the manner prescribed therein or in any obligation of anycounty, township, city or school district which has abonded indebtedness not exceeding 15%of its total assessedvaluation.
