Article 12.--LIBRARIES

     
12-1223.   Same; Johnson county;
corporate status of library board.

(a)   Except as provided by subsection (b), the library board of a library
established under, or governed by the provisions of this act shall constitute
a body corporate and politic, possessing the usual powers of a corporation
for public purposes, under the
name and style of "the board of directors of _______________ (name of
municipality) library" and under such name may contract, sue and be sued
and acquire, hold and convey real and personal property in accordance with
law. The acquisition or disposition of real property shall be subject to
the approval of the governing body of the municipality.

     
(b)   In Johnson county, the library board shall constitute a body corporate
and politic possessing the usual powers of a corporation for public purposes,
under the name and type of "the board of directors of _______________ (name
of municipality) library" and under such name may contract, acquire, hold
and convey real and personal property in accordance with the law. The acquisition
or disposition of real property shall be subject to the approval of the
board of county commissioners. The library board in such county may sue
with permission of the board of county commissioners, by resolution, and
be sued only in the name of "The Board of County Commissioners of the County
of __________;" pursuant to K.S.A. 19-105, and amendments thereto.
