12-1249. Issuance of library bonds by certain counties between 6,600and 7,300; duties of planning commission and governing board of city inwhich building to be located; election provisions.The board of county commissioners of any county having a population ofmore than six thousand six hundred (6,600) and less than seven thousandthree hundred (7,300) and having an assessed tangible valuation of lessthan twenty-one million dollars ($21,000,000) and in which there is locateda city of the second class which maintains a library is authorized to issuegeneral obligation bonds of the county to acquire a site and construct abuilding to be used for library purposes in such second-class city. Beforeany such bonds are issued under authority of this act the governing body ofsuch city shall request the recommendations of its library board as to thelocation and type of building needed to best serve the community, includingthe provision of such library materials as may be appropriate for use inconnection with vocational or technical training. Upon receipt ofrecommendations from its library board the governing body of any such cityshall transmit a copy thereof to the planning board of such city for itsrecommendations as to site location and accessibility. Such planning boardshall promptly consider and act upon such recommendations by giving itsadvice thereon to the governing body of such city. Upon receipt of therecommendations of the planning board the governing body of such city shallby resolution duly adopted submit to the board of county commissioners ofsuch county its findings as to the advisability of issuance of bonds underauthority of this act and its recommendations as to location, type ofconstruction and such other recommendations as it may deem appropriate.Such resolution shall be transmitted to the board of county commissionersby such city and upon receipt thereof such board of county commissioners isauthorized to issue general obligation bonds of the county in an amount notin excess of one percent (1%) of the assessed tangible valuation of thecounty: Provided, No bonds shall be issued under authority of this actuntil the same have been approved by the electors of such county at aspecial election called for the purpose or at a general election, and anysuch election shall be conducted and such bonds shall be issued in themanner prescribed in chapter 10 of Kansas Statutes Annotated.
