12-1261.   Same; procedure to create district; election; transfer of assetsand liabilities.(a) The board of trustees of the Topeka public library mayadopt a resolutionproposing to create a library district. A copy of such resolution shall befiled with the county election officer who shall call and hold an electionthereon. Such election shall be called and held in the manner provided by thegeneral bond law.

      (b)   If a majority of the qualified electors of theproposedlibrary district who reside within the corporate limits of the city and amajority of the qualified electors of the proposed library district who resideoutside the corporate limits of the cityvoting on theproposition vote in favor thereof:

      (1)   A library shall be established andmaintained and a library board shall be appointed as provided in this act;

      (2)   all contracts entered into by the board of directors of the Topekapublic library shall be binding on the library board appointed pursuant to thisact;

      (3)   all outstanding bonds, debts and other obligations of the Topeka publiclibrary shall become an obligation of the Topeka and Shawnee county publiclibrary; and

      (4)   all rights, property and other assets of the Topeka public library shallbe transferred to the Topeka and Shawnee county public library.
