12-1306. Eminent domain.Whenever it shall become necessary in any city to condemn or appropriateland within or without the limits of the city for publicparks for the useand benefit of the people of thecity and the governing body of the city declares it necessary tocondemn or appropriate any private property for which thepurchase pricecannot be agreed upon with the owner of such property,the governing body of the city shall causea survey to be made by a licensed land surveyor or a professional engineerwho is competent to conduct a land survey, and such survey anddescription of the land so required shall befiled with the city clerk. Thereupon, the governing body of thecity shall make an orderdeclaring the necessity of suchappropriation and the purposes for which the land is to becondemned orappropriated and a description of the land as shown bythe survey, and allother and further proceedings necessary for the condemnation andappropriation of the land shall be had and conducted asprovided by law.
