Chapter 12.--CITIES AND MUNICIPALITIES
Article 16.--MISCELLANEOUS PROVISIONS

      12-1617h.   Securing industries in or near cities; tax levy, use of proceeds;election required; resubmission, when; use of general fund or other revenue sources.Cities are hereby authorized to levy annually upon all thetaxable tangible property within the city a tax for the purposeof creating a fund to beused in securing or retaining industries or manufacturing institutions for suchcityor near its environs and to pay a portion of the principal and intereston bonds issued by such city under the authority of K.S.A. 12-1774, andamendments thereto. No such levy shall be made untilthe governing body is instructed to do so bya majority of all the votes cast on this proposition at an election held at anycity or general election.

      Such election shall be held as provided by law for bond elections. If anysuch city shall not make such taxlevy in any year, after the third year following the approval of suchtax levy by the voters, then it shall be necessary to resubmit the issueto the voters before any such tax levy shall be imposed again.

      Nothing in this section shall be construed as restricting the authorityof cities to utilize the general fund or other revenue sources for thepurpose of promoting or securing the location or expansion of business andindustry.
