12-1789. Same; protest petition to repealordinance; dissolution of district.Within 45 days following publication of an ordinanceestablishing a district pursuant to K.S.A. 12-1788, and amendmentsthereto, or the publication of an ordinance levying annual service feespursuant to K.S.A. 12-1791, and amendments thereto, the ownersof businesses located within the district may file with the governing bodyof the city a petition in opposition to thecontinuation of the district or the levying of such service fees. Upona finding that a petition opposing the establishment of thedistrict was signedby not less than a majority of the number of businesses located within thedistrict, no service fee shall be levied within the district and thedistrict shall be dissolved. Upon the finding that a petitionopposing the levy of service fees for theensuing year was signed by not less than a majority of the number ofbusinesses located within the district, no service fees shall be leviedpursuant to the ordinance specified in such petition and the district shallbe dissolved as of the end ofthat calendar year. The governing body, by ordinance, shallrepeal the ordinance which established the district or theordinance which levied the annual service fees, effective as of the end ofthat calendar year. After the payment of all costs incurred by thedistrict for that calendar year, the city shall return any unusedand unencumbered moneys collected and distribute such moneysback to the businesses on a pro rata basis in the same percentage as suchmoneys were collected.
