Chapter 12.--CITIES AND MUNICIPALITIES
Article 19.--PUBLIC RECREATION AND PLAYGROUNDS

      12-1925.   Establishment by petition or by action of city or schooldistrict; election.(a) Whenever a petition signed by at least 5% of thequalified voters of the city or school district isfiled with the clerk thereof, requesting the governing body of the cityor school district to establish arecreation system and to levy an annual tax not to exceed one mill for suchrecreation system and to pay a portion of the principal and interest onbonds issued pursuant to K.S.A. 12-1774, and amendments thereto,the governing body of the city orschool district shall submit the question of establishing a recreationsystem to the qualified voters thereof.Such election shall be called and held in the manner provided by thegeneral bond law, and the cost of the election shall be borne by such cityor school district.

      (b)   A petition requesting the governing bodies of a city and schooldistrict to establish a joint recreation system and signed by at least 5%of the qualified voters of the city or school district may be filed withthe clerk of the city or school district.Upon receipt of the petition, the clerk shall set a day not less than five normore than 10 days thereafter for the joint meeting of the two governingbodies for the consideration of the petition.Notice of the receipt of the petition and the date and place ofthe joint meeting shall be given immediately by the clerk to the executiveofficer of the city and school district by registered mail.If the petition is foundsufficient, the proposition shall be submitted to the qualified voters within thecity or school district, whichever has the greater assessed valuation.Such election shall be called and held in the manner provided by thegeneral bond law, and the cost of the election shall be borne equally bythe city and the school district.

      (c)   The governing body of any city and anyschool district may initiate the establishment of a jointdistrict recreation system by adopting a joint ordinance or resolutionproposing to establish a joint recreation system and to levy anannual tax not to exceed one mill for such recreation system and to pay aportion of the principal and interest on bonds issued pursuant to K.S.A.12-1774, and amendments thereto.The proposal shall be submittedfor approval by the voters of the city or school district,whichever has the greater assessed valuation, at an election called andheld in the manner provided by the general bond law, and the cost of theelection shall be borne equally by the city and the school district.

      (d)   Upon approval of the proposition by a majority of those voting on itat the election, the governing body of the city or school district ifacting independently or the governing bodies of a city and schooldistrict acting jointly, by appropriate resolution or ordinance, shallprovide for the establishment, maintenance and conduct of suchrecreation system as they deem advisable and practicable and shallappoint a recreation commission as provided by K.S.A. 12-1926 to be vestedwith the powers, duties and obligationsnecessary for the conduct of such recreation system.
