12-2909. Same; enforcement of city ordinances by sheriff; sheriff's approval.
(a) The board of county commissioners of any county and the governing body
of any city located within the county may enter into a contract providing
for the enforcement of the city's ordinances by the sheriff of the county
or other officers of the sheriff's department. Any contract entered into
pursuant to this section shall be submitted to and approved by the county
sheriff. Failure of the sheriff to approve a contract within 30 days of
its submission shall constitute disapproval thereof. All monetary
consideration paid by a city to a county as part of the contract shall be
expended by the county solely for law enforcement
purposes. The sheriff and any officers of the sheriff's department assigned
responsibility for enforcing a city's ordinances under the
contract shall be designated therein and shall have all the powers of any
other police officer of the city by virtue of the
existence of the contract.
(b) A contract entered into pursuant to this section shall not be regarded
as an interlocal agreement under the provisions of K.S.A. 12-2901 et
seq., and amendments thereto.
