12-5324.   Grant fee.(a) Subject to the provisions ofK.S.A. 2009 Supp.12-5338, and amendmentsthereto, effective July 1, 2004, there is hereby established a wirelessenhanced 911 grant feein theamount of$.25 per month per wireless subscriber account with primary place of use in thestate of Kansas.It shall be the duty of each wireless carrier to collect such fee fromthe wireless serviceuser and remit such fee to the secretary as provided byK.S.A. 2009 Supp.12-5331, andamendments thereto.

      (b)   Subject to the provisions ofK.S.A. 2009 Supp.12-5338, and amendmentsthereto, thereis herebyestablished a wireless enhanced 911 grant fee in an amount equal to 1% of theretail price of anyprepaid wireless service sold in the state. It shall be the duty of eachwholesaler of prepaidwireless service to remit such fee to the secretary as provided by K.S.A. 2009Supp. 12-5331,andamendmentsthereto.

      (c)   The secretary shall remit to the state treasurer, in accordance with theprovisions of K.S.A.75-4215, and amendments thereto, any fees received pursuant to this section.Upon receipt of theremittance, the state treasurer shall deposit the entire amount in the statetreasury and credit it to thewireless enhanced 911 grant fund.
