12-5333.   Wireless enhanced 911 service declaredgovernmental power; limitation on liability.The wireless enhanced 911 service described in the wirelessenhanced 911 actis within the governmental power and authority of the secretary, localcollection point administrator,governing bodies and public agencies. Except as provided by the Kansas tortclaims act, incontracting for such service and in providing such service, and except forfailure to use ordinary care,or for intentional acts, the secretary, local collection point administrator,each governing body, eachpublic agency, each wireless carrier and their employees and agents shall notbe liable for thepayment of damages resulting from the performance of installing, maintaining orproviding wirelessenhanced 911 service.
