12-5508. Same; contractor's exclusive right to provide service.
The municipality may agree that the sole and exclusive
right to provide the capital intensive public service within its
jurisdiction be assumed by the private contractor under the service
agreement in the same manner and subject to the same limitations and
conditions that would apply if the capital intensive public service and
related facilities were acquired, constructed, owned and operated
exclusively by the municipality.
