Chapter 12.--CITIES AND MUNICIPALITIES
Article 6.--PUBLIC IMPROVEMENTS

      12-631e.   Certain cities may alter, repair, construct or reconstructsewers; payment by city at large; bonds.If the governing body of any city located in acounty which has a population of less than20,000 and an assessedtangible valuation of more than $45,000,000 and in whichsewer districts have been created determines that itis necessary to alter,repair or reconstruct any existing sewer or construct any additionalsewer which serves two or more districts or which serves a substantialportion of the city, the governing body may provide therefor and may (1) assess the costthereof against the sewer district or sewer districts speciallybenefited, (2) if the governing body determines that the costthereof should be borne by the city at large, pay such cost out of thegeneral fund of the city or (3) issue its general improvement bonds to paytherefor in the manner provided by law.

      Whenever the governing body of any such city determinesthat thecost of any such construction or reconstruction should be borne by thecity at large and paid for by the issuance of its general improvementbonds, the governing body shall adopt a resolution stating such factand the amount of bonds which it deems necessary to issue and sell. The governing bodyshall publish such resolution once each week for two consecutive weeks in a paper ofgeneral circulation in such city. After publication,such bonds may be issuedand sold, unless a petition in opposition to the same, signed by qualifiedelectors of the city equal in number to not lessthan 15% of the qualified electors of such city who voted for the officeof secretary of state at the last precedingelection at which such office was subject to election, is filed with thecity clerk of such city within 30days following the last publication of the resolution. If such apetition is filed,the governing body of such city shall submit the question to the qualifiedelectors of such city at a special election called for such purpose orat the next general city election.

      The total amountof bonds issued by any city under the authority conferred by this actshall not exceed the sum of $100,000.

      The provisions of law relating toconstruction and pavement of streets shall be followed in the letting ofall contracts and the levying of any special assessments under theprovisions of this act.
