12-750. Same; subdivision regulations affecting property outside the city;joint committee; membership; authority.(a) If the governing body of a city proposes to adopt subdivision regulationsaffecting property lying outside of the city and governed by subdivisionregulations of the county, a copy of the city's proposal shall be certified tothe board of county commissioners or if at any time subsequent to the adoptionof regulations governing the subdivision of land by the city planningcommission, the board of county commissioners shall designate an area for suchpurposes which shall include lands lying within the area governed bysubdivision regulations of the city, the board of county commissioners shallcertify a copy of such resolution to the governing body of the city andregulations governing the subdivision of land within the area designated by thecity shall be adopted and administered in the manner hereinafter provided.Within 60 days after the date of the certification of the resolution by theboard of county commissioners or the governing body of the city, there shall beestablished by joint resolution of the board of commissioners andgoverning body, a joint committee for subdivision regulation which shall becomposed of three members of the county planning commission to be appointed bythe chairperson of the county planning commission and three members of the cityplanning commission to be appointed by the chairperson of the city planningcommission and one member to be selected by the other six members. Such jointcommittee shall have such authority as provided by law for county planning andcity planning commissions relating to the adoption and administration ofregulations governing the subdivision of land within the area of jointregulation. Regulations adopted by the county or city and in effect at the timeof the certification of such resolution by the board of county commissioners orthe governing body of the city shall remain in effect until new regulationsshall have been adopted by the joint committee or for a period not exceedingsix months from and after the date of the certification of such resolution. Theprovisions of this section shall not apply to any city and county jointlycooperating in the exercise of planning and zoning under the provisions of thisact.
(b) The provisions of this section shall become effective on and afterJanuary 1, 1992.
