Chapter 12.--CITIES AND MUNICIPALITIES
Article 7.--PLANNING AND ZONING

      12-761.   Same; violations; penalties;actions.(a) Any violation of any regulation adopted under the authority of thisact shall be a misdemeanor and shall be punishable by a fine of not to exceed$500 or by imprisonment for not more than six months for each offense or byboth such fine and imprisonment. Each day's violation shall constitute aseparate offense.

      (b)   Any city or county, and any person the value or use of whoseproperty is or may be affected by such violation, shall have the authorityto maintain suits or actions in any court of competent jurisdiction toenforce the adopted zoning regulations and to abate nuisances maintained inviolation thereof.

      (c)   Whenever any building or structure is or is proposed to be erected,constructed, altered, converted or maintained or any building, structure orland is or is proposed to be, used in violation of any zoning regulations,the city or county, or in the event the violation relates to a provisionconcerning flood plain zoning, the attorney general and the chief engineerof the division of water resources of the Kansas department ofagriculture, in addition to other remedies, may institute injunction,mandamus, or other appropriate action or proceeding to prevent suchunlawful erection, construction, reconstruction, alteration, conversion,maintenance or use or to correct or abate such violation or to prevent theoccupancy of such building, structure or land.

      (d)   Any person, company, corporation, institution, municipality or agency ofthe state who violates any provision of any regulation relating to flood plainzoning shall be subject to the penalties and remedies provided for herein.

      (e)   The provisions of this section shall become effective on and afterJanuary 1, 1992.
