Chapter 12.--CITIES AND MUNICIPALITIES
Article 8.--PUBLIC UTILITIES

      12-839.   Same; notice; hearing; election in cities of second class.Before the passage of the ordinance provided for in K.S.A. 12-838, themayor of the city, upon the receipt of a petition signed by atleast 10% of the taxpayers of the city, shall cause to be published inthe official city paper a notice signed by the mayor and attested by thecity clerk. Such notice shall state that, in pursuance of a resolution previouslyadopted, anordinance will be passed on a datespecified in the notice, providing forthe improvement of the system of waterworks in accordance with plans andspecifications covering such improvement on file in the office of thecity clerk and providing bonds for the payment for the cost ofsuch improvement, naming the amount.Such notice shall also provide that any person objecting to suchimprovement or the issuance of bonds may appear before the council orboard of commissioners during such time and be heard as to suchobjection. Such notice shall be published once each week for two consecutiveweeks, the last publication to be more than 10 daysprior to the date fixed therein for the passage of such ordinance.

      If, in a city of the second class, before the passage of theordinance provided for in K.S.A. 12-838, 25% ofthe qualifiedelectors of the city petition the city governing body to submit suchordinance to a vote of the electors of such city,the city governing bodyshall submit such ordinance to a vote of the people before suchordinance is passed, and shall be governed by the result of suchvote.
