Chapter 12.--CITIES AND MUNICIPALITIES
Article 8.--PUBLIC UTILITIES

      12-846.   Same; procedure.Whenever the governing body of any such city shall determine toconstruct or authorize the construction of any such improvements asprovided in K.S.A. 12-845 the governing body may proceed as provided by lawto condemn the necessary lands or rights-of-way: Provided, Any personthrough or over whose lands any of such lines may be constructed or whowould be otherwise damaged thereby may give consent thereto in writing, andsuch writing, with or without formal acknowledgment, may be recorded in theoffice of the register of deeds of the proper county, and such city shallhave the same right to construct and maintain such lines as though suchlands and rights had been formally condemned.
