12-850. Same; unlawful use without franchise; penalty.Any person, firm, or corporation, their agents, servants, or employees,who shall, without first having obtained by ordinance from such municipalauthorities, as hereinbefore provided, authority so to do, enter upon anyof the streets, alleys, public parks or grounds of such cities andinterfere with the surface thereof, or dig ditches, or obstruct the same inany way, or otherwise interfere therewith, shall be guilty of a misdemeanorfor each day this act shall be thus violated, and upon conviction thereofshall be fined in any sum not exceeding one hundred dollars for each suchoffense: Provided, That in cities of the second and third class wherestreet grades have been established property owners adjacent to such mayfill in such streets to the center thereof so as to bring them up to suchgrade.
