Article 10.--PUBLIC IMPROVEMENTS

      13-1029.   Sewer districts for pumping stations and sewers; assessmentsand bonds.Cities of the first class may create districts for the purpose ofconstructing and maintaining pumping stations and main and interceptingsewers, and in creating such districts may include therein the whole or anypart of any two or more sewer districts then or theretofore established.The lands which will be especially benefited by the proposed pumpingstation and sewer or either of them shall constitute such districts, andthe boundaries of such districts shall be determined by ordinance. The lotsand tracts of land situated in such sewer district shall, regardless ofassessments for any pumping station or pumping stations and sewer or sewerstheretofore levied thereon, be liable to special assessments for the costof such pumping stations and sewers, including the cost of acquiring, bycondemnation or purchase, lands or any easement or right therein deemednecessary by the governing body for the construction or maintenance of suchpumping stations and sewers.

      The cost and expense of constructing such sewers and procuring rights ofway shall be assessed against the lots or pieces of land contained in thedistrict in which the same are situated, and the special assessment shallbe levied by the city and certified by the city clerk to the county clerk,to be placed on the tax rolls for collection, subject to the same penaltiesand collected in like manner as other taxes. Such city may join with anyperson, company or corporation owning property adjacent to or adjoiningsuch city, but not within the city, in the construction of such pumpingstations and main and intercepting sewers and in acquiring rights of waytherefor on such terms and conditions as may be determined on by thegoverning body of such city. Negotiable bonds may be issued to pay for suchpumping stations and sewers, including the cost of lands or any easement orright therein acquired by condemnation or purchase, in the manner providedby law.
